ONLINE TERMS & CONDITIONS OF SALE

These terms and conditions (Terms) apply to all orders placed online by you (Order) with KYHA Studios LLC (we, us) on our website (including www.kyhastudios.com) (Website) for gowns, apparel and products in the KYHA Studios or KYHA Bride collections (Product).

KYHA Bride is our ready-to-wear bridal collection. Gowns and apparel in our KYHA Bride collection are made in set sizes and are not made to your individual measurements. If you order a gown from the KYHA Bride collection, you may need to arrange alterations (Alteration Services) at your cost to tailor the gown to your desired fit, which at minimum will include a hem alteration.

Ordering

When you place an Order for a Product and pay us the Order Price (as defined in Clause 2), we agree to provide you with the Product you have ordered in accordance with these Terms. Once you place your Order, you will receive a confirmation email with your Order details and a suggested date by which your Product will be shipped to the shipping address you provide.

Payment

The Order will state the Order Price, which includes: the price for the Product, any shipping/postage fees, any applicable Rush Fee, Additional Fees, and other charges (Order Price).
We accept payment via our online payment platform or authorised payment processors. We will not begin production (if applicable) or dispatch your Product until payment of the Order Price is made in full and received by us.
The Order Price does not include any import duties, taxes, tariffs or customs fees on goods supplied to you; you must pay those directly where applicable.

Completion of Order

For gowns ordered (unless a rush order) we will aim to ship to your shipping address within up to 5 months after the date of your Order. If the Order is a rush order, you agree to pay the applicable rush fee as notified when you place your Order.
For other Products, we will arrange shipment to your shipping address typically within 1–2 business days after the order date, subject to stock, production and shipping constraints.
You acknowledge that scheduled completion dates and shipping timeframes may be delayed due to factors outside our control (for example changes in sizing, natural disaster, pandemic or other Force Majeure Event). It is your responsibility to allow for possible delays when choosing when to place your Order and your event date.
We reserve the right, at our discretion, to refuse or cancel your Order for any reason, to fulfil only part of the Order, or to refuse to ship to certain countries, jurisdictions or locations.

Size Selection

You confirm that you have selected the size online for your gown or apparel. We may assist you with standard sizing via phone or video consultation, but you remain responsible for providing accurate bust, waist and hip measurements in inches or centimeters.
If you fall between sizes, we may (at our option) offer a “Extra Length”; additional fees will apply. If you require any changes beyond these, you will need to use Alteration Services. We cannot guarantee we can accommodate Split Size or Extra Length in all designs due to design or fabric constraints.

Fluctuations

When choosing your gown or apparel, you acknowledge that body measurements may fluctuate between your Order date and fulfilment. Alteration Services may not be able to accommodate certain fluctuations (depending on fabric, design or timing). You agree that you will not be entitled to a refund or other compensation if the garment does not fit due to such fluctuations. We will make reasonable efforts to inform you before Order if alterations cannot be performed.

Gowns – Exchange or Store Credit

We will not provide a refund for a gown that you ordered simply because you changed your mind.
If you purchase a gown that is in stock and in a standard size and it is in perfect, resalable condition, it is eligible for exchange or store credit. To request an exchange or store credit you must notify us at enquiries@kyhastudios.com within 7 days of your receipt of the gown. You must return the gown to us within 14 days (at your cost), at which point we will assess its condition. If we determine it is in perfect, resalable condition, we will provide you a link or list of available gowns for exchange within your size, timeframe and budget. If no suitable exchange is available, we will issue you a store credit equal to the purchase price. Store credits must be used within 24 months of issue. Gowns purchased that are made-to-order (not in stock), or customised in any way are not eligible for exchange or refund unless clause 9 applies (defective product).

Other Products – Exchange or Store Credit

We will not provide a refund for a Product you ordered simply because you changed your mind.
Ready-to-wear products (excluding gowns, customised products and noted exclusions) that are in perfect, resalable condition are eligible for return or store credit. You must return the Product within 14 days of receipt at your cost. Once we receive and assess the Product, if eligible, we will provide a refund or store credit. Store credits must be used within 24 months of issue.

Exceptional Products

Sale, Archive and RENEW items and customised items are final sale and ineligible for return or exchange (unless clause 9 applies).
For hygienic reasons, undergarments (including shapewear and underwear) and earrings are ineligible for return or exchange (unless clause 9 applies).

Faulty Products & U.S. Consumer Protection Law

We warrant that Products will be supplied consistent with applicable U.S. federal and state consumer protection laws (including laws prohibiting unfair or deceptive acts or practices). 
Nothing in these Terms excludes or limits any rights you may have under applicable U.S. law that cannot be excluded or limited by agreement.
You must inspect your gown or Product upon receipt and promptly notify us of any defect, damage or discrepancy (with photographs and proof of purchase). We may, at our option:

  • Repair or replace the Product; or

  • Provide a refund of the purchase price.
    If the Product has a major defect, you may elect a refund or replacement, subject to return of the Product to us at our cost in the United States, where applicable.

Limitation of Liability

Subject to applicable U.S. law, we will not be liable for any loss or damage you suffer resulting from:

  • damage caused by you or your chosen alterer;

  • any Alteration Services performed by you or third parties;

  • the Product not being ready by your event date due to a Force Majeure Event;

  • your use of the Website; or

  • any measurement fluctuation.

Indemnity

You will indemnify and hold us harmless from any direct, reasonably foreseeable loss or claim we suffer (whether negligence, tort, statute or otherwise) as a result of your breach of these Terms or our exercise of our rights under them.

Intellectual Property

All intellectual property rights in the Product and Website content remain our exclusive property. You must not copy or replicate any design or part of it nor instruct any third party to do so. Unless you notify us otherwise in writing, by placing an Order you grant us the right to use photographs and videos you post of your wearing the gown or Product for promotional purposes including on our social media and website.

Online Account

You may register for an account on our Website. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must not share your login or allow others access.

Use of Website

You must not:

  • reproduce or distribute Website material;

  • retransmit Website content by any medium;

  • commit or assist criminal or unlawful acts;

  • transmit or distribute malicious or harmful software;

  • hack or corrupt data or systems;

  • infringe the rights of others;

  • send unsolicited advertising (“spam”);

  • modify or copy Website layout or code.

Miscellaneous

If any clause of these Terms is unlawful, void or unenforceable under U.S. law, it shall be severed and the remainder of the Terms will continue in effect.
These Terms shall be governed by and construed under the laws of the State of New York, United States of America, and the parties submit to the non-exclusive jurisdiction of the courts of New York.
